II. Treaty Membership
1. Paris Convention for the Protection of Industrial Property (Paris Convention)
Accession: 1991

Bangladesh has not yet joined the Madrid Agreement or the Madrid Protocol, nor has it joined the Hague Agreement and the Patent Cooperation Treaty (PCT). Therefore, trademarks, designs and patents in Bangladesh can only be applied for directly.

III. Trademark Application Procedure and Required Documents
1. Trademark Registrable Elements and Types
Elements that can be registered as trademarks in Bangladesh include: words, graphics, letters, numbers, etc.
The types of trademarks that can be registered in Bangladesh are: trademarks, service marks, collective marks, certification marks and defensive marks.

⦁ List of goods and/or services;
⦁ Clear representation of the mark;
⦁ Power of attorney;
⦁ Date of first use in Bangladesh and proof thereof. If the trademark has not yet been used, a declaration of intent to use is required.

4. Application Procedure and Timeline
Filing: the 11th edition of Nice Classification is adopted; multiple class applications are not allowed; the first-to- file principle is followed.
Examination: formal examination and substantive examination; 6 months.
Publication/Opposition: The opposition period is 60 days.
Registration: 15 months from filing to registration (if smooth).

5. Protection Period and Renewal
The validity period is 7 years from the date of application and can be renewed for 10 years each time before expiration.

6. Assignment
Trademark assignment requires a power of attorney from the assignee and a legalized assignment agreement, and the process takes about one and a half years.

7. Chang of Name/Address
Trademark changes require a power of attorney and a notarized proof of change, and the processing period is approximately one and a half years.

8. Cancellation
Non-use Cancellation: If a trademark has not been used for 5 consecutive years, any interested party may file a cancellation request for the non-used trademark.
