1. Trademark Registrable Elements and Types
Elements that can be registered as trademarks in Kuwait include: text, graphics, slogans, three-dimensional logos, color combinations, sounds, smells, etc.
The types of trademarks that can be registered in Kuwait are: trademarks, service marks, collective trademarks and certification trademarks.

2. Application Process
Filing: the 11th edition of Nice Classification is adopted (registration of alcoholic beverages in Classes 32 and 33 and pork products in Class 29 is not accepted; Class 33 has been completely abolished, and Class 34 of the International Classification has been restored for tobacco products); multiple-class applications are not allowed; the first-to-file principle is followed.
Examination: formal examination and substantive examination.
Publication/Opposition: the opposition period is 60 days.
Registration: It takes about 1 year from filing to registration (if smooth).
2. Protection Period and Renewal
The validity period is 10 years from the date of application. It can be renewed within 1 year before the expiration date with a grace period of 6 months, and each renewal is valid for 10 years.
6. Assignment
Registered trademarks can be assigned. An assignment agreement and power of attorney legalized by the embassy or consulate must be provided, and the processing period is approximately 2 months.
7. Chang of Name/Address
Registered trademarks can be changed. A proof of change and power of attorney legalized by the embassy or consulate must be provided, and the processing period is approximately 2 months.
8. Cancellation
Non-use Cancellation: If a trademark has not been used for 5 consecutive years, any interested party may file a cancellation request for the non-used trademark.
