I. General Overview
Area: 676,578 square kilometers.
Myanmar has a population of 54.17 million and is home to 135 ethnic groups, primarily the Burmese, Karen, Shan, Kachin, Chin, Kayah, Mon, and Rakhine. The Burmese make up approximately 65% of the total population. The official language of Myanmar is Burmese , a language belonging to the Tibeto-Burman branch of the Sino- Tibetan language family . Each ethnic minority has its own language, with the Kachin, Karen, Shan, and Mon having their own written language. There are approximately 2.5 million ethnic Chinese living abroad. Over 85% of the population is Buddhist, and approximately 8% is Muslim. In the 2023/2024 fiscal year, Myanmar's GDP was projected to be US$79.3 billion, a growth rate of 2.64%.
II. Treaty Membership
None. Myanmar's newly enacted Trademark Law came into effect on April 1, 2023. The Myanmar Intellectual Property Office does not accept trademark registrations under the old system or during the transition period, and only accepts new applications.
III. Trademark Application Procedure and Required Documents
1. Trademark Registrable Elements and Types
Elements that can be registered as trademarks in Myanmar include: words, graphics, letters, numbers, color combinations, etc. Smells and tastes are not registrable.
The types of trademarks that can be registered in Myanmar include: trademarks, service marks, collective trademarks and certification trademarks.

2. Application Process
Filing: the 12th edition of Nice Classification is adopted; multiple-class applications are possible; the first-to-file principle is followed
Examination: formal examination and substantive examination.
Publication/Opposition: The opposition period is 60 days.
Registration: It takes about 1-2 years from filing to registration (if smooth).
2. Protection Period and Renewal
The validity period is 10 years from the date of application. It can be renewed within 6 months before the expiration date with a grace period of 6 months, and each renewal is valid for 10 years
6. Assignment
There are no clear operating rules for trademark assignment in Myanmar. An assignment agreement is usually required, and the processing period is uncertain.
7. Chang of Name/Address
There are no clear operating rules for trademark changes in Myanmar. Proof of change is usually required, and the processing time is uncertain.
8. Cancellation
Non-use Cancellation: If a trademark has not been used for three consecutive years, any interested party may file a cancellation request for the non-used trademark.
