CNIPA Does Not Send Foreign Owners a Reminder

There is no notice to your overseas address, no email, no warning at the eleven-month mark. The obligation to track the date sits entirely with the registrant.
For a company holding one Chinese mark that is manageable. For a company holding fifteen across several classes, filed at different times by different agents, it is exactly the kind of administrative detail that quietly slips — until a competitor notices the lapse before you do.
This gets harder in 2027. Today a lapsed mark is shielded for twelve months by Article 50, which blocks others from registering it. The revised law removes that shield for non-renewal, leaving only voluntary surrender protected. From 1 January 2027, missing a renewal means the mark is available to anyone the day it lapses.

The real cost

A Lapsed Mark Does Not Simply Wait for You

This is the part most foreign owners underestimate.

Renewed in the window

Protection continues without interruption for ten more years, running from the day after the previous term ended. Nothing is lost.

Renewed in the grace period

Still recoverable. You pay the ¥225 late surcharge on top of the official fee. Protection continues, but you have spent money you did not need to.

Missed both

The registration is cancelled. Until the end of 2026 a one-year buffer under Article 50 blocks others from registering an identical mark. From 1 January 2027 that buffer disappears for non-renewal: a lapsed mark becomes available immediately.

A company with one Chinese trademark rarely loses it. Companies lose marks when they hold eight or twelve, filed across several years, in different classes, sometimes through different agents after a rebrand or acquisition — and no single person owns the calendar.

China Trademark Renewal FAQs

Within the twelve months immediately before the registration expires, under Article 40 of the Trademark Law. You cannot renew earlier than that. If the window is missed there is a further six-month grace period, but it carries a late surcharge.
The registration is cancelled and your rights in the mark end. Under current law, Article 50 gives a small mercy: for one year afterwards CNIPA will not approve an identical or similar mark from anyone else. That buffer is being removed. Under the revised Trademark Law effective 1 January 2027, the one-year block applies only where a registrant voluntarily surrenders a mark — non-renewal no longer qualifies. From that date a lapsed registration is open for a competitor or squatter to file immediately.
No. CNIPA issues no renewal reminders to foreign registrants. There is no email, no letter to your overseas address. If nobody on your side is tracking the date, the first indication that something is wrong is usually discovering the mark has lapsed, by which point the grace period may also have run.
The CNIPA official fee is RMB 450 for electronic filing. Filing during the six-month grace period adds a late surcharge of RMB 225, bringing the official cost to RMB 675. Paper filing is higher at RMB 500, or RMB 750 in the grace period. Our attorney fee is quoted separately and confirmed before any work begins.
Ten years, running from the day after the previous term ended, not from the date you filed the renewal. So renewing early within the window does not shorten your protection. Renewal can be repeated indefinitely.
